Privacy Policy

This Privacy Policy describes how The Superposition, LLC (“The Superposition,” “we,” “us,” or “our”) collects, uses, shares, and protects your information when you use Seph and all related websites, applications, APIs, and services (collectively, the “Service”). Please read this Policy carefully. By using the Service, you agree to the practices described here. This Privacy Policy is incorporated into and governed by our Terms of Service.

1. Summary: Third-Party AI Services

Seph is a voice-first AI creative collaborator. To function, the Service transmits your prompts, audio recordings, text inputs, and related Content to third-party AI service providers that perform language model inference, speech-to-text, and text-to-speech processing on our behalf. We want you to understand this clearly before you use the Service.

Who we send data to, what we send, and why is listed in full in Section 4 below. The third-party AI providers we currently use are Anthropic, Google, Deepgram, and InWorld. Each of these providers is contractually obligated to protect your information to a standard materially equivalent to what we describe in this Policy, and each is contractually prohibited from using your Content to train their own general-purpose models.

In-app consent. Before the Seph app transmits your Content to any third-party AI service for the first time, the app presents you with a disclosure identifying the providers, the categories of data that will be sent, and the purposes of that transmission, and asks you to affirmatively consent. If you do not consent, the core AI features of the Service will not function. You can review or withdraw this consent at any time in the app’s settings; withdrawing consent will disable the affected features.

2. Information We Collect

Information you provide directly.

  • Account information. When you create an account, we collect your name, email address, and any other information you provide through our identity provider (currently Clerk), including information from third-party sign-in providers (such as Google) if you choose to use them.
  • Content. We collect all text, audio, images, notes, conversations, transcripts, files, and other material you submit to, upload to, create through, or develop using the Service, including your Worlds and all associated creative material. See our Terms of Service for how Content ownership works.
  • Payment information. If you purchase paid features (such as Model training), we collect payment details through our payment processor. We do not store full credit card numbers on our servers.
  • Communications. If you contact us at support@thesuperposition.ai or otherwise communicate with us, we collect the content of those communications.

Information collected automatically.

  • Usage data. We collect information about how you interact with the Service, such as features used, session duration, and actions taken within the Service.
  • Device and connection information. We collect your IP address, browser type, operating system, device type, and general geographic location (derived from IP address).
  • Cookies and similar technologies. We use cookies and similar technologies to maintain your session, remember your preferences, and support authentication. See Section 9 (Cookies) for details.

Information generated through your use of the Service.

  • AI-generated Content. When you interact with Seph or with a Model, the Service generates responses, notes, and other outputs. These are treated as your Content under our Terms of Service.
  • Models. When you use model training features, the Service creates Model weights and artifacts derived from your Content. Model weights are owned by The Superposition as described in the Terms of Service; the intellectual property in the underlying creative material remains yours.

How we collect this information.

We collect information (a) directly from you when you create an account, submit Content, make a payment, or contact us; (b) automatically from your device and the Service when you use it (through server logs, authentication cookies, and application telemetry); and (c) from third parties you authorize to share information with us (such as third-party sign-in providers if you choose to use them).

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide and operate the Service. This includes processing your conversations with Seph, training and running Models associated with your account, exporting notes to destinations you authorize (such as Google Sheets), and authenticating your identity. Operating the Service necessarily involves transmitting your Content to the third-party AI service providers described in Section 4.
  • To maintain and improve the Service. We use aggregated and de-identified usage data to understand how the Service is used, diagnose technical issues, and improve features and performance. We do not use your Content to train general-purpose AI models or any models not associated with your account.
  • To communicate with you. We may send you service-related messages (such as account verification, security alerts, changes to terms, and billing notices). We do not send marketing emails without your consent.
  • To enforce our Terms and protect the Service. We may use your information to detect and prevent fraud, abuse, security incidents, and violations of our Terms of Service.
  • To comply with legal obligations. We may process your information as required by applicable law, regulation, or valid legal process.

4. Third-Party AI Services and Sub-processors

To operate the Service, we share specific categories of your data with the third-party service providers listed below. We have entered into data processing agreements with each provider that require them to (a) process your data only for the purposes described below, (b) protect your data with security and privacy practices materially equivalent to those described in this Policy, and (c) refrain from using your Content to train their own models.

Third-party AI service providers.

The following providers receive your Content for AI processing. These are the providers covered by the in-app consent described in Section 1.

We do not send your payment information, your account password, or any data beyond what is listed in the “Data sent” column to these providers.

Other sub-processors.

The following providers support the Service but do not receive your Content for AI training or generative processing:

We may add, remove, or substitute sub-processors over time. When we make a material change to the third-party AI services that receive your Content, we will update this Policy and notify you in accordance with Section 16.

Equivalent protection.

Each third-party provider listed above has committed, through a written data processing agreement, to protect your information with privacy and security measures that are materially equivalent to the measures we describe in this Policy. Each AI provider has further committed in writing not to use your Content to train their own general-purpose models.

Permission-based sharing.

If you share a World with other Users (as described in our Terms of Service), the Content you share becomes accessible to those Permissioned Users within the scope you authorize. You control what you share and with whom.

Google Sheets.

If you connect your Google account and authorize the Service to export notes to Google Sheets, we write information to your Google account on your behalf. Once written, that information is subject to your agreement with Google.

Legal requirements.

We may disclose your information if we believe in good faith that disclosure is necessary to (a) comply with applicable law, regulation, or valid legal process; (b) protect the rights, property, or safety of The Superposition, our Users, or the public; (c) detect, prevent, or address fraud, security, or technical issues; or (d) enforce our Terms of Service.

Business transfers.

If The Superposition is involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change and any choices you may have regarding your information.

No sale of personal information.

We do not sell your personal information. We do not share your Content with third parties for their own purposes.

5. In-App Consent Before Data Is Sent to Third-Party AI Services

The Seph app obtains your affirmative, informed consent before it transmits your personal data to any third-party AI service for the first time. Specifically:

  • On first launch, and before any AI-powered feature is used, the app presents a disclosure screen that identifies the third-party AI service providers listed in Section 4, describes the categories of data that will be sent to each, and describes the purpose of each transmission.
  • You must affirmatively tap to grant consent. If you decline, the core AI features of the Service will not function, but you may continue to use features that do not require third-party AI processing.
  • You can review the current set of third-party AI providers and withdraw your consent at any time from within the app’s settings. Withdrawing consent will disable the affected features and halt further transmissions to third-party AI services. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal.
  • If we add a new third-party AI service provider that receives your Content, we will request your renewed consent before transmitting your data to that new provider.

6. AI Model Training and Your Content

Because AI and model training are central to the Service, we want to be especially clear about how your Content is used in this context:

  • Per-account training only. We use your Content to train Models that are associated with your account and your Worlds. We do not use your Content to train general, shared, or any other models that are not associated with your account.
  • No selling or licensing of Content for training. We do not sell, license, or otherwise make your Content available to any third party for the purpose of training that third party’s models.
  • Third-party AI provider restrictions. Each of the third-party AI providers listed in Section 4 is contractually prohibited from using your Content to train their own general-purpose models. We rely on these providers’ contractual commitments and published policies.
  • Aggregated data. We may use aggregated and de-identified operational telemetry — data that cannot reasonably be used to reconstruct your Content — for analytics, research, and product improvement.

7. Data Retention

While your account is active.

We retain your information, including your Content, for as long as your account is active and as needed to provide the Service.

After account termination.

When you close your account or request data deletion, we retain your data for 30 days to allow you to change your mind, reinstate your account, or export your Content. After the 30-day retention window, your data is permanently deleted from our active systems.

Backups.

Residual copies of your data may persist in routine backups for a limited additional period, after which they are overwritten in the normal course of backup rotation.

Legal retention.

We may retain certain information longer where required by applicable law, to resolve disputes, or to enforce our Terms of Service.

8. Your Rights and Choices

You have the following rights regarding your information:

  • Access. You may request a copy of the personal information we hold about you.
  • Correction. You may request that we correct inaccurate personal information.
  • Deletion. You may request that we delete your personal information and Content. Deletion is subject to the 30-day retention window described in Section 7.
  • Export. You may request an export of your Content in a commonly used format.
  • Withdraw consent. Where processing is based on your consent — including the in-app consent described in Section 5 — you may withdraw consent at any time. Withdrawal does not affect the lawfulness of processing that occurred before withdrawal.
  • Object to processing. In certain circumstances, you may object to processing of your personal information.

To exercise any of these rights, contact us at support@thesuperposition.ai. We will respond within a reasonable timeframe and in accordance with applicable law. We may need to verify your identity before fulfilling your request.

9. Cookies and Similar Technologies

We use only essential cookies — specifically, authentication session cookies set by our identity provider (Clerk) — which are required for the Service to function. These cookies maintain your signed-in session and cannot be disabled without breaking the Service.

We do not use analytics cookies, advertising cookies, behavioral tracking pixels, or fingerprinting technologies. We do not serve ads on the Service.

Most browsers allow you to control cookies through their settings. Blocking essential cookies may prevent you from using the Service.

10. Data Security

We implement commercially reasonable technical and organizational measures to protect your information against unauthorized access, alteration, disclosure, or destruction. These include encryption in transit (TLS), access controls, and secure infrastructure provided by our cloud hosting provider (Microsoft Azure).

No method of transmission over the internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. If we become aware of a security breach that affects your personal information, we will notify you in accordance with applicable law.

11. Children

The Service is not intended for anyone under the age of 18. We do not knowingly collect personal information from individuals under 18. If we learn that we have collected personal information from someone under 18, we will take steps to delete that information promptly. If you believe a child under 18 has provided us with personal information, please contact us at support@thesuperposition.ai.

12. International Data Transfers

The Superposition is based in the United States, and the Service is hosted and operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your jurisdiction.

We do not specifically target the Service to users in the European Union, the European Economic Area, or the United Kingdom. If you access the Service from these or other regions with laws governing data collection and use, you do so at your own initiative and consent to the transfer of your information to the United States.

We rely on our contractual agreements with sub-processors and the data protection practices described in this Policy to provide appropriate safeguards for your information.

13. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) provide you with specific rights regarding your personal information:

Right to know.

You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, our business purpose for collecting it, and the categories of third parties with whom we share it.

Right to delete.

You have the right to request that we delete the personal information we have collected from you, subject to certain exceptions permitted by law.

Right to correct.

You have the right to request that we correct inaccurate personal information we maintain about you.

Right to opt out of sale or sharing.

We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising. Because we do not engage in these practices, there is no need to opt out.

Right to non-discrimination.

We will not discriminate against you for exercising any of your CCPA/CPRA rights.

Categories of personal information collected.

In the preceding 12 months, we have collected the following categories of personal information (as defined by the CCPA):

  • Identifiers — name, email address, IP address, account credentials.
  • Internet or other electronic network activity information — browsing history within the Service, usage data, device information.
  • Geolocation data — approximate location derived from IP address.
  • Commercial information — records of services purchased (such as Model training).
  • Audio, electronic, or visual information — audio recordings submitted through speech-to-text features.
  • Other information you provide — Content, including conversations, Worlds, notes, and other creative material.

How to exercise your rights.

To exercise any CCPA/CPRA right, contact us at support@thesuperposition.ai. We will verify your identity before fulfilling your request. You may also designate an authorized agent to make a request on your behalf.

We aim to respond to verifiable requests within 45 days. If we need additional time, we will notify you of the extension and the reason.

14. Do Not Track

Some browsers transmit a “Do Not Track” (DNT) signal. Because there is no accepted standard for how to respond to DNT signals, the Service does not currently respond to them. However, as described in Section 9, we do not use third-party advertising cookies or behavioral tracking technologies.

15. Third-Party Links and Services

The Service may contain links to or integrations with third-party websites and services (such as Google Sheets). This Privacy Policy does not apply to those third-party services. We encourage you to review the privacy policies of any third-party services you access through or in connection with the Service.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes — including changes to the set of third-party AI service providers that receive your Content — we will notify you by posting a notice in the Service, emailing the address associated with your account, or another reasonable means. The updated Policy takes effect on the date indicated at the top. Your continued use of the Service after the effective date constitutes your acceptance of the updated Policy. If you do not agree to the updated Policy, your sole remedy is to stop using the Service and close your account.
